2. Information We Collect

From Business Clients: Business name, address, contact information, email, phone number, and payment information.

From End Customers: First name, phone number, and email address when provided.

3. How We Use Your Information

• Sending automated SMS review requests on behalf of local businesses
• Managing Google Business Profile reviews
• Providing monthly reports to business clients
• Processing payments for our services

4. SMS Messaging and TCPA Compliance

We comply fully with the Telephone Consumer Protection Act and CTIA messaging guidelines.

• Customers consent by giving their phone number to the business at point of service
• Maximum of 2 messages sent per customer per visit
• Every message includes opt out instructions
• Customers can opt out at any time by replying STOP

5. How We Share Your Information

We never sell rent trade or share your personal information with third parties except trusted service providers needed to deliver our services or when required by law.

• Opt Out of SMS: Reply STOP to any message
• Access: Request a copy of your information
• Deletion: Request deletion of your information

1. Agreement to Terms

By accessing or using the services of Exelr8Reviews.com you agree to be bound by these Terms and Conditions.

2. Description of Services

Exelr8Reviews.com provides reputation management services including automated SMS review requests, email follow up messages, custom branded review pages, QR code materials, monthly reporting, and Google Business Profile monitoring.

3. SMS Messaging Terms

• Messages are sent to existing customers who provided their phone number at point of service
• Maximum of 2 SMS messages per customer per business visit
• Reply STOP to opt out at any time
• Reply HELP for assistance or contact hello@exelr8reviews.com
• Message and data rates may apply
• Carriers are not liable for delayed or undelivered messages

4. Client Responsibilities

• Provide accurate customer contact information collected with proper consent
• Only submit real customers with existing business relationships
• Comply with all applicable laws including TCPA and CAN-SPAM Act
• Not offer incentives in exchange for reviews in violation of Google policies
• Pay all fees on time as outlined in service agreement

5. Google Review Policy Compliance

We only facilitate genuine review requests. We never generate fake incentivized or misleading reviews.

6. Payment Terms

• Payment due on the 1st of each month
• Late fee of 25 dollars applies after 10 days
• Services may be suspended after 30 days non-payment
• No refunds for partial months already paid
• Either party may cancel with 30 days written notice

7. Limitation of Liability

We do not guarantee a specific number of reviews or minimum star rating. Our maximum liability is limited to fees paid in the prior 30 day period.

8. Governing Law

These terms are governed by the laws of the State of Florida. Disputes shall be resolved through binding arbitration in Vero Beach Florida.
